Terms and conditions

This agreement sets out the terms and conditions that will govern the relationship between us, Meadowlark Productions (Meadowlark Productions LLP) and you, the member/payer. It is a legally binding agreement. These conditions are important to maintain standards and to ensure that all members gain the maximum benefit from their enrolment.

 

By enrolling at Meadowlark Productions, you accept these terms and conditions (“Terms & Conditions”) and sign your agreement to them as an ongoing agreement between you and Meadowlark Productions (“Agreement”). The Agreement is made between the member/fee payer (“you” or “your) and Meadowlark Productions (“Meadowlark Productions”, “we”, “our”, “us”) (trading as Meadowlark Productions LLP) and is valid at all times whilst the member is enrolled on any Meadowlark Productions activity and until such time as written notice is given in accordance with these Terms & Conditions.

 

 

  1. INTRODUCTION:

 

1.1. These Terms & Conditions apply to all our Meadowlark Productions rehearsals, shows, and any additional products and/or services offered by Meadowlark Productions in the future for any member.  

 

1.2. For participation of a member in a Meadowlark Productions Activity all members/Fee Payers are required to consent to these Terms & Conditions by signature or by ticking the acceptance box for these Terms & Conditions when submitting a membership payment online. We may update these Terms & Conditions from time to time.

 

1.3. Any changes to these Terms & Conditions require the written consent or approval of Meadowlark Productions.

 

1.4 A “show” refers to a series of rehearsals including singing, dancing and drama which will be delivered, followed by a show at the end of the rehearsal period. Rehearsals will take place twice per week for a certain number of hours, as detailed on the website and social media.

 

1.5. “Online activity” refers to online streamed lessons/Workshops utilising the Zoom platform or alike delivered by Meadowlark Productions.

 

 

  1. ENROLLMENT PROCESS & ENROLLING A NEW MEMBER IN A MEADOWLARK PRODUCTIONS SHOW

 

2.1. To become a new member for a Meadowlark Productions show, the member/Fee Payer must agree to these Terms & Conditions and either contact Meadowlark Productions regarding a free taster rehearsal, or pay for a show fee.

 

2.2. All such terms and conditions shall be incorporated into the Agreement and shall be deemed to have been accepted by the member/Fee Payer upon payment by, or on behalf of, the member/Fee Payer.

 

2.3. Times, Dates, fees and all relevant details for booked Meadowlark Productions shows will be confirmed via email for each Meadowlark Productions Show. 

 

2.4. From the date the fee is paid, you have a seven (7) calendar day cancellation period (“Cancellation Period”) to change your mind and cancel the member’s place on the Meadowlark Productions Show. You will be entitled to a full refund of the show fee.

 

2.5. After the Cancellation Period expires, the fee is non-refundable and will be retained by Meadowlark Productions.

 

 

  1. FEES

3.1. Fees are divided into a payment per show. This fee will vary depending on the show. Timetables and rehearsal leaders are subject to change without notice. The fee does not include meals, show tickets or transportation which remains your responsibility.

 

3.2 Fees must be paid before the first rehearsal of the show. Payment must be made by Direct Debit or through the website payment gateway. If payment of fees is not made in full or in alignment with the payment option selected at enrolment for any reason subject to any alternative agreements made with the Committee we reserve the right to suspend your membership and to exclude you from Meadowlark Productions. Payment plans may be arranged at the discretion of the Meadowlark Productions Committee. Late fee payment for members joining after the start of the rehearsal period may be arranged at the discretion of the Meadowlark Productions Committee.

 

3.3. The minimum enrolment period is one show. You must pay the fee in alignment with the option selected at enrolment by Bank Transfer or online via the website for the minimum enrolment period unless your enrolment is terminated without liability, suspended or transferred in accordance with these terms. Meadowlark Productions reserves the right to change the day, time and location of the sessions. Should this be restrictive to performing in the show, you may be entitled to a partial refund at the discretion of the Meadowlark Productions Committee.

 

3.4. Any free or discounted taster session is strictly at the approval of the Committee, subject to availability and does not guarantee a place at Meadowlark Productions. A free trial may not be claimed in retrospect.

 

3.5. In the event that you are unable to attend a scheduled Meadowlark Productions activity, due to sickness (subject to the clause below), holiday, government restrictions or a decision by you not to attend, Meadowlark Productions is unable to offer any refund of fees paid, or make up the missed session.

 

3.6. We will suspend enrolment during the minimum enrolment period (specified in the above clause 3.3) in the event that you are unable to attend Meadowlark Productions for more than one month due to your injury or illness. In the unfortunate event that it is medically no longer possible for you to attend Meadowlark Productions we will cancel the minimum enrolment period without any further obligation to you. We may require suitable medical evidence in the form of a GP or hospital letter setting out the medical reasons in order to sanction this. You may be entitled to a partial refund at the discretion of the Meadowlark Productions Committee.

 

3.7. In the event that you do not make the show fee payment when due, the right to attend Meadowlark Productions will be withdrawn until payment is received and brought up to date.

  

3.8 We reserve the right to revert to online sessions for any enforced closure outside of our control. This includes, but not limited to, national and localised shutdown due to weather, pandemic, venue availability and lockdown. Where Meadowlark Productions is running physical face-to-face sessions, or a combination of physical face to face sessions and online sessions, or exclusively online sessions the standard fee applies and is payable via bank transfer or online via the website.

 

3.9. If Meadowlark Productions is unable to accept you due to capacity reasons, you may, at your discretion, be placed on a reserve list.

 

3.10. If you wish to cancel your membership to Meadowlark Productions and have notified the Committee, you may no longer participate in the show.

 

3.11 Meadowlark Productions reserves the right to deny membership to any individual. 

 

 

4. TASTER SESSIONS

 4.1. Where a new member is attending a show for the first time, subject to availability, Meadowlark allows a one (1) session trial period (“Taster session”) so that the member may try a session of the show. The taster session only applies to new members and will only be available to attend once arranged with the Committee.

 

5. CONDUCT

5.1. In order to avoid disturbing rehearsals, members are requested to arrive on time to the rehearsal. Entrance to rehearsals may be barred to anyone arriving more than 15 minutes late.

 

5.2. A rehearsal leader or Committee member may, at any time, ask you to leave a rehearsal or show if you are jeopardising the safety or enjoyment of others or their experience.

 

5.3. You must treat all Meadowlark Productions members, rehearsal leaders and Committee with respect and consideration. Meadowlark Productions does not tolerate rude, offensive, or aggressive remarks and behaviour in any way.

 

5.4. You must make yourself aware of the health and safety rules of the venue and comply with the recommendations at all times. Meadowlark Productions will endeavour to disclose any health and safety risks where applicable, but members are responsible for their own health and safety.

 

5.5. Bullying, harassment, abuse or other inappropriate behaviour by you or your guests is strictly forbidden and will result in expulsion and such other legal remedies as may be available.

 

5.6. Smoking and the bringing or consumption of alcohol and the use or being under the influence of illegal substances is not permitted anywhere in our venues.

 

5.7. If you have a complaint or concern, please contact the Committee directly and we will do our best to resolve the matter.

 

5.8. We may terminate your enrolment and discontinue your entitlement to attend Meadowlark Productions in the event of serious or repeated breach of these rules.

 

5.9 You must not bring an individual to any Meadowlark Productions rehearsals who is not a member of Meadowlark Productions. In exceptional circumstances, an agreement can be made with the Meadowlark Productions committee. 

 

USE OF PERSONAL INFORMATION

6.1. The personal data (as it is defined in the Data Protection Act 2018) of member/Fee Payer will be processed by Meadowlark Productions in accordance with its Privacy Policy. A hard copy of the Privacy Policy can be requested from info@meadowlarkproductions.co.uk

 

6.2. Meadowlark Productions owns all the rights, title and interest in and to its websites, including software, text and media and its trade marks, logos and brand elements. Nothing within these Terms & Conditions affects or licences the ownership of these rights. Any intellectual property created during any show is owned by Meadowlark Productions.

 

6.3. Any material, scores, scripts, choreography, music and concepts from original musical theatre works created for Meadowlark Productions are the intellectual property of the writer/composer and must not be used or shared in relation to any external activities other than for the sole purpose of Meadowlark Productions LLP. Nothing within these Terms & Conditions affects or licences the ownership of these rights in any other capacity unless agreed with the Committee.

 

 

7. HEALTH AND SAFETY

7.1. Members participate at their own risk and are obliged to inform Meadowlark Productions and its staff of any existing injuries or medical condition. All application forms must have any known medical conditions stated and any changes to such information must be notified to Meadowlark Productions immediately in writing.

 

7.2. Any medication on the premises must be clearly labelled and the member should, unless Meadowlark Productions has agreed in writing otherwise, be able to administer it themselves.

 

7.3. If you are unsure whether you should participate in any activity please consult your GP before enrolling in a Meadowlark Productions show.

 

7.4. Members must wear suitable footwear and clothing at all times.

 

7.5. If a member is unwell or has an accident requiring emergency treatment, the Emergency Contact will be contacted via the emergency contact details provided on the enrolment form. This number must always be contactable whilst the member is attending Meadowlark Production activities.

 

7.6. Members/Fee payers are solely responsible for ensuring that the emergency contact details on Meadowlark Productions’ records are up to date and give permission for these contact details to be stored on the specific Committee representatives’ phones.

 

7.7  Promptness for rehearsals is necessary for all members as all warmups are mandatory to ensure the health and safety of all our participants.

 

7.8 Due to the nature of dance it may be necessary for our team to use physical contact when teaching performers.

 

8. PERSONAL PROPERTY

8.1. Meadowlark Productions can accept no liability for lost or damaged belongings. Members are obliged to take care of their own belongings.

 

8.2. Any items left on Meadowlark Productions operating premises are done so at the owners own risk and Meadowlark Productions can accept no liability for the security of these items.

 

9. GENERAL

9.1. Meadowlark Productions reserves the right to make changes to the timetable, the teaching staff, the advertised programme or the programme delivery mechanism (for clarity this may mean that we switch to online sessions on platforms such as Zoom) in the event of illness or other circumstances beyond our control.

 

9.2. Where a session of a Meadowlark Productions activity has to be cancelled by Meadowlark Productions, the Committee will give as much notice as possible. In the event of a last minute session cancellation, you will be notified by email or through a designated Meadowlark Productions social media site.

 

9.3. Members/Fee Payers must ensure that they provide the Committee with up-to-date contact details.

 

9.4. It is occasionally necessary to change the time and/or venue of a Meadowlark Productions activity session. This will only be done if absolutely necessary and Meadowlark Productions will do its best to keep class times, programme delivery mechanisms and/or locations as similar as possible but unfortunately this cannot always be guaranteed.

 

9.5. We reserve the right to use any individual or group photographs or movie shots of you for social media, press or promotional purposes.

 

9.6 We reserve the right to make changes to these rules.

 

9.7. Meadowlark Productions may, at its own discretion, refuse a member entry to a Meadowlark Productions activity if it is felt that the member’s past or present behaviour is unacceptable.

 

9.8. You acknowledge that the maximum aggregate liability of Meadowlark Productions to a member under these Terms & Conditions shall not exceed the Meadowlark Productions show fee to which a claim relates.

 

9.9. The liability of Meadowlark Productions and that of its staff is restricted to show time only and then only to gross negligence.

 

9.10. Meadowlark Productions show fees are reviewed after each show and may be increased accordingly.

 

9.11. This agreement may be terminated if either party is in serious breach of its obligations to the other.

 

9.12 Participants must be available for all the rehearsal and performance dates and must be fully committed to Meadowlark Productions for the rehearsal period. In exceptional circumstances planned absences must be discussed with the Committee.

 

9.13 Under no circumstance may participants take any costumes, set or props from the venue. Any costumes, set and props must be treated with the utmost respect. You may be liable for any unnecessary damage caused to costumes, set or props.

 

9.14 These Terms & Conditions, together with any Enrolment confirmation or Fee note constitute the entire agreement between the parties which supersedes and extinguishes all previous agreements, promises, assurances, warranties, representations and understandings between them, whether written or oral, relating to its subject matter.

 

9.15. This agreement is governed by the laws of England and Wales.
